Right to Walk on Footpaths is a Fundamental Right, Rules Supreme Court

New Delhi, June 20: In a landmark judgment strengthening the rights of pedestrians across the country, the Supreme Court of India has ruled that walking safely on a demarcated footpath is a fundamental right of every citizen.

A bench comprising Justices P.S. Narasimha and A.S. Chandurkar observed that a citizen’s right to walk on a designated footpath takes precedence over the movement of motorized vehicles. The Court emphasized that pedestrian rights must be given priority in urban planning and road infrastructure.

The apex court held that the right to walk forms an integral part of the freedom of movement guaranteed under Article 19(1)(d) of the Constitution, as well as the Right to Life and Personal Liberty under Article 21. The judges noted that safe and accessible footpaths are essential for ensuring citizens can exercise these constitutional rights.

The Court further stated that the responsibility for constructing, maintaining, and protecting footpaths from encroachments lies with local authorities and civic bodies. Failure to provide safe pedestrian infrastructure could amount to a violation of citizens’ constitutional rights.

The judgment comes at a time when pedestrians in many Indian cities face significant challenges due to encroached footpaths, illegal parking, and inadequate urban planning. Road safety experts believe the ruling could have far-reaching implications for city development policies and pedestrian-friendly infrastructure across the country.

Legal experts have described the verdict as a major step toward promoting inclusive and people-centric urban development. By placing pedestrians at the center of public infrastructure planning, the Supreme Court has reinforced the principle that roads are meant not only for vehicles but also for the safe movement of people.

The ruling is expected to encourage civic authorities to prioritize pedestrian safety and ensure that footpaths remain accessible, safe, and free from obstructions.
